General Terms and Conditions for Use of the Application

Preamble
These Terms and Conditions constitute the legal framework governing the use and operation of the application and the services provided through it. They are intended to regulate booking services and the management of medical appointments, set out the rules relating to the use of the application and the protection of data, and define the rights and obligations of the relevant parties, in accordance with the applicable laws and regulations of the State of Qatar.
Notice
The role of the application in relation to the user is limited to being a technical electronic platform that enables the booking, organization, and management of appointments and related services. It does not constitute a provider of any medical, healthcare, or treatment services, nor does it provide any medical advice or consultations. The Medical Provider alone shall bear responsibility for its services, appointments, content, and for any acts or omissions issued by it or by its affiliates or authorized users, including any delay, cancellation, rescheduling, amendment, or error relating to the service or the appointment.
Scope of the Application
These Terms and Conditions apply to the use of the application and the services provided through it by all relevant parties, including the Application Provider, the Medical Provider, and the user, depending on the nature of the use and the role associated with each party.
Definitions
A- Application Provider: The entity that owns and operates the application and holds the rights relating to it, where applicable. Yalla Systems For Electronic Services W L L, Registered in the State Of Qatar.
B- Medical Provider: The hospital, health center, clinic, or medical entity participating in the application, including its authorized employees or users depending on the nature of use.
C- User: The individual who uses the application or whose data is entered into it for the purpose of booking, managing an appointment, or the related service.
D- Data: Personal data or other data processed or referred to in accordance with the applicable Privacy Policy.
E- Legitimate Use: Any use of the application or processing of data within the legitimate purposes necessary to provide the service, operate the application, and manage appointments and related services, in accordance with applicable laws and regulations.
F- Application: The mobile application, website, or any authorized digital interface of the Application Provider relating to the services provided through it.
Acknowledgment and Consent
Your use of this application constitutes an express acknowledgment that you have read and fully agreed to the Terms and Conditions. This does not prejudice the requirement to obtain any additional approvals or authorizations necessitated by the nature of the service or by applicable or customary legal requirements.
Chapter One: Rights and Obligations of the Application Provider
- The Application Provider retains all ownership and intellectual property rights relating to the application, including, by way of example and without limitation, the design, software, code, user interfaces, and trademarks, whether such rights are established under or protected by the applicable laws and regulations.
- The Application Provider may issue, amend, or update these Terms and Conditions as required by technical, legal, or operational needs, and may impose appropriate restrictions to ensure the quality, continuity, and security of the application.
- The Application Provider seeks to operate and develop the application in accordance with an appropriate level of technical, organizational, and security standards, and to provide updates as necessary depending on the nature of the service. This shall not constitute a guarantee that the application will be free from interruptions, malfunctions, errors, or vulnerabilities.
- The Application Provider may issue technical, security, or enhancement updates as necessary for the application, and shall provide notice of such updates where appropriate depending on the nature of the update.
- The Application Provider seeks to apply the standards and controls referred to in the Privacy Policy and the documents related to the application, to the extent appropriate to the nature of the service, the operation of the platform, and the role of the Application Provider in relation to it.
- The Application Provider shall not process any data except within the scope of legitimate use necessary for operating, maintaining, supporting, developing, and making technical modifications to the application, enabling booking and appointment management services and the related features, ensuring the continuity of the application, and limiting misuse, in accordance with applicable laws and regulations, without prejudice to any optional processing activities or features that may require additional user consent or permission where appropriate.
- The Application Provider shall not be liable for damages, losses, or consequences arising from misuse of the application or its unlawful or unauthorized use by the Medical Provider, its employees, the user, or any other party.
- The Application Provider shall not be liable for any loss, damage, or claim arising, directly or indirectly, from:
- a- any data, information, or content entered, uploaded, submitted, modified, or created by the Medical Provider, the user, or any other party through the application, including data relating to appointments, services, prices, timings, or any similar details.
- b- any legal violation or failure by any party to obtain the necessary approvals, permits, or authorizations, or to comply with the laws, regulations, or policies applicable to it.
- c- any interruption, suspension, malfunction, technical error, deficiency, delay, or unavailability of the application or any of its services or functions, or any attempted breach, unauthorized access, vulnerability, or potential technical risk.
- d- any direct or independent communication or dealings between the Medical Provider and the user outside the operation of the platform or outside the permitted purposes.
- e- failure by others to follow the policies or general guidelines issued by the Application Provider.
- f- any loss, damage, or delay resulting from force majeure or from circumstances or events beyond the reasonable control of the Application Provider.
This shall apply in a manner proportionate to the nature of the service and the reasonable operational capabilities of the Application Provider.
- The Application Provider may, as it deems appropriate and to the extent necessary to protect the platform, its operation, its users, or the participating Medical Providers, suspend, restrict, or terminate access to the application or any of its features or services, temporarily or permanently, in relation to any party, including the Medical Provider, its employees, the user, or any other party, in cases of misuse, breach of these Terms and Conditions, security or operational risks, or any other circumstances requiring such action.
- The Application Provider provides no express or implied warranty as to the continuous or uninterrupted availability of the application or any of its features or services to any party, and its operation may be affected by maintenance, updates, malfunctions, or technical or operational circumstances.
- The Application Provider may, as it deems appropriate and subject to technical, legal, or operational requirements, modify, develop, suspend, or discontinue any of the application’s features, services, or functions, in whole or in part, temporarily or permanently.
Chapter Two: Rights and Obligations of the Medical Provider
- The Medical Provider may use the application for the purposes of organizing, coordinating, and managing appointments and related services, in accordance with the functionalities made available through the platform and in compliance with these Terms and Conditions and applicable laws.
- The Application Provider may make available technical or operational support channels to the Medical Provider as it deems appropriate and in accordance with the applicable arrangements.
- The Medical Provider may manage the data necessary for organizing, coordinating, arranging, and managing appointments and related services through the application, within the purpose designated for such data and in accordance with applicable laws and regulations.
- The Medical Provider shall use the application only for the purposes of booking, organizing, coordinating, and managing appointments and related services, and in accordance with the functionalities made available through the platform, these Terms and Conditions, and applicable laws and regulations.
- The Medical Provider is prohibited from exporting, selling, analyzing, sharing, or reusing any data for commercial, marketing, or statistical purposes without the user’s explicit consent, and in accordance with applicable laws and regulations.
- The Medical Provider shall ensure that there is an appropriate legal basis for processing or using data, including any notices, consents, or authorizations required where mandated by law, and in accordance with applicable laws and regulations.
- The Medical Provider shall provide and update the data and information necessary for booking and managing services or appointments in a clear and reasonably accurate manner, and shall be responsible for the accuracy of the data or information it provides through the application. The Medical Provider shall also be responsible for any direct dealings or communications it carries out with the user in relation to the relevant service, appointment, or booking.
- The Medical Provider shall:
- a- secure the devices of its employees or authorized users through which the application is used or accessed.
- b- secure the access methods, accounts, devices, and environments used to access or use the application or website.
- c- establish and apply appropriate internal confidentiality and data protection policies, and comply with applicable laws and regulations.
- d- take appropriate measures to prevent unauthorized access or entry.
- The Medical Provider shall comply with the instructions issued by the Application Provider in relation to the operation, security, updates, and use of the application, to the extent appropriate to the nature of the service and the role of each party.
- The Medical Provider shall be responsible for any misuse of the application or website by it, its employees, or its authorized users, and for any breach, leakage, unlawful use, or unlawful exploitation of data falling within its scope of responsibility or resulting from its acts or the acts of those acting under its authority in this regard.
- The Medical Provider shall comply with these Terms and Conditions and the applicable Privacy Policy, and shall maintain its relevant data and information updated to the extent necessary for the proper operation and use of the application
- The Medical Provider shall be responsible for the lawfulness of the services it provides or makes available for booking through the application, including any required licenses, permits, approvals, or regulatory obligations, and shall also be responsible for any dealings, decisions, or actions relating to its services, appointments, or related communications.
Chapter Three: Rights and Obligations of the User
- The user shall, where applicable under law and regulations, have the following rights:
- a- the right to access their data.
- b- the right to request correction of their data.
- c- the right to request deletion of their data where applicable, in accordance with applicable laws and regulations, the nature of the data, and the purpose of processing.
These rights may be exercised through the Medical Provider or through the Application Provider, depending on the nature of the data and the purpose of processing.
- The user shall provide accurate and correct data to a reasonable extent, and follow the policies and instructions issued by the Medical Provider in relation to the relevant service, appointment, or booking.
- The user shall be responsible for the accuracy of the data provided and for the consequences of any direct dealings with the Medical Provider in this regard. The Application Provider shall not be responsible for such direct dealings or for any consequences arising from them outside the operation of the platform or outside the permitted purposes.
- The user shall not use the application in any manner that causes harm, disruption, or losses to any party, or for any unlawful purpose or in violation of applicable laws and regulations.
- The user agrees to these Terms and Conditions and undertakes to comply with them when using the application or any of its services.
- The user agrees to the applicable Privacy Policy and shall comply with it.
- The user shall be responsible for the user’s use of the application, the accuracy of the information or data provided through it, and any act or action taken by the user from the time of registration in the application, through booking, confirming, managing, and completing the appointment, and any dealing between the user and the Medical Provider relating to the relevant service, appointment, or booking. The Application Provider shall not be responsible for such direct dealings or for any consequences arising from them outside the operation of the platform or outside the permitted purposes.
- The user shall keep login credentials, verification methods, and any account-related information confidential and shall not share them with others. The user shall be responsible for any consequences arising from their use by the user or by any person who obtained them through the user.
- The user shall notify the Application Provider without delay upon suspecting any unauthorized use of the account or any access or act that may affect the security of the application, its data, or the user’s bookings.
- The user shall confirm or manage the appointment, or take any related action whenever requested to do so, and in accordance with the period or manner specified by the platform or the Medical Provider depending on the nature of the service.
Chapter Four: General and Final Provisions
- 1- Governing Law and Jurisdiction
These Terms and Conditions shall be governed by the laws of the State of Qatar, and the Qatari courts shall have jurisdiction.
- 2- Governing Language
In the event of any conflict or discrepancy in interpretation between the Arabic and English texts, the Arabic text shall prevail.
- 3- Nature of the Application Provider’s Role
The Application Provider shall not be considered the owner or operator of the medical entities participating in the application.
- 4- No Medical Advice
The Application Provider does not provide any medical advice or consultation, and the application and any content or information made available through it shall not constitute a substitute for medical consultation, medical assessment, or professional medical decision-making. The user shall observe and comply with the foregoing. The Application Provider shall not be responsible for any medical or health-related decision or action, or for any consequences resulting therefrom.
- 5- Relationship Between the User and the Medical Provider
Any relationship relating to the medical service, appointment, booking, or any related interaction, decision, or action shall remain between the user and the Medical Provider. The Application Provider shall not be responsible for such matters.
- 6- The applicable Privacy Policy shall form an integral part of these Terms and Conditions.
- 7- The Application Provider may amend or update these Terms and Conditions from time to time, and the amended version shall take effect from the date it is published or made available through the means deemed appropriate by the Application Provider.
- 8- If any provision of these Terms is found to be unenforceable or incapable of application under any applicable law, this shall not affect the validity or enforceability of the remaining provisions, and the Terms shall remain in force, binding, and legally effective.
